11.Description of MarketinqApplicant intends to market its services to primarily toresidential customers and to small to mid-sized businesses.Allsales personnel will have telecommunications service experience.Applicant will market through direct sales by employees andagents.Applicant does not intend to engage in multilevelmarketing at this time. NATIONAL ACCESS LONG DISTANCE, INC.ORIGINAL SHEET7SOUTH DAKOTA PUC TARIFF NO. 1TELECOMMUNICATIONS SERVICES TARIFFSECTION 1-TECHNICAL TERMS AND ABBREVIATIONSAccess Line - A n arrangement from a local exchange telephonecompany or other common carrier, using either dedicated orswitched access, which connects a Customer's location to theCompany's location or switching center.Authorization Code - A numerical code, one or more of whichmay be assigned to a Customer, to enable the Company to identifythe origin of the Customer so it may rate and bill the call.Automatic number identification (ANI) is used as theauthorization code wherever possible.Commission - Used throughout this tariff to mean the SouthDakota Public Utilities Commission.Customer - The person, firm, corporation or other legalentity which orders the services of the Company and isresponsible for the payment of charges and for compliance withthe Company's tariff regulations.Company or National Access - Used throughout this tariff tomean National Access Long Distance, Inc., a Nevada Corporation.Dedicated Access - The Customer gains entry to the Company'sservices by a direct path from the Customer's location to theCompany's point of presence.Holiday - New Year's Day, Independence Day, Labor Day,Thanksgiving Day and Christmas Day. Services are furnished subject to theavailability of facilities and subject to the terms andconditions of this tariff in compliance withlimitations set forth in the Commission's rules. TheCompany's services are provided on a statewide basisand are not intended to be limited geographically. TheCompany offers service to all those who desire topurchase service from the Company consistent with allof the provisions of this tariff. Customers interestedin the Company's services shall file a serviceapplication with the Company which fully identifies theCustomer, the services requested and other informationrequested by the Company. The Company reserves theright to examine the credit record and check thereferences of all applicants and Customers. TheCompany may examine the credit profile/record of anyapplicant prior to accepting the service order. Theservice application shall not in itself obligate theCompany to provide services or to continue to provideservice if a later check of applicant's credit recordis, in the opinion of the Company, contrary to the bestinterest of the Company. The Company may act as theCustomer's agent for ordering access connectionfacilities provided by other carriers or entities whenauthorized by the Customer, to allow connection of aCustomer's location to a service provided by theCompany. The Customer is alsoresponsible for the payment of charges forservices provided under this tariff.2.4.2The Customer is responsible for chargesincurred for special construction and/orspecial facilities which the Customerrequests and which are ordered by the Companyon the Customer's behalf.2.4.3If required for the provision of theCompany's services, the Customer must provideany equipment space, supporting structure,conduit and electrical power without chargeto the Company.2.4.4The Customer is responsible for arrangingaccess to its premises at times mutuallyagreeable to the Company and the Customerwhen required for Company personnel toinstall, repair, maintain, program, inspector remove equipment associated with theprovision of the Company's services.2.4.5The Customer shall cause the temperature andrelative humidity in the equipment spaceprovided by Customer for the installation ofthe Company's equipment to be maintainedwithin the range normally provided for theoperation of microcomputers.ISSUED:ISSUED BY:,2002EFFECTIVE:J. NATIONAL ACCESS LONG DISTANCE, INC.ORIGINAL SHEET14SOUTH DAKOTA PWC TARIFF NO. 1TELECOMMUNICATIONS SERVICES TARIFF2.4.6The Customer shall ensure that the equipmentand/or system is properly interfaced with theCompany's facilities or services, that thesignals emitted into the Company's networkare of the proper mode, bandwidth, power andsignal level for the intended use of thesubscriber and in compliance with criteriaset forth in this tariff, and that thesignals do not damage equipment, injurepersonnel, or degrade service to otherCustomers. If the Federal CommunicationsCommission or some other appropriatecertifying body certifies terminal equipmentas being technically acceptable for directelectrical connection with interstatecommunications service, the Company willpermit such equipment to be connected withits channels without the use of protectiveinterface devices. If the Customer fails tomaintain the equipment and/or the systemproperly, with resulting imminent harm toCompany equipment, personnel or the qualityof service to other Customers, the Companymay, upon written notice, require the use ofprotective equipment at the Customer'sexpense.
