-2Sections260.20 and 260.22 establisha petitionprocess whichallowsa facilityto demonstratethat its waste, althoughcapturedbythe broad listingsof Section261 Subpart D, does not meet anyincludingthe presenceofcriteriaunder which the waste was listed,Decisionson waste delistinghave alwaysadditionalconstituents.been based on a chemicalcharacterizationof the waste itselfand ofthe processesgeneratingthat waste, not on facilitydesign,Therefore,untila finalmanagement practicesor site conditions.decisionis made to grant the petition,the waste is hazardousand thefacilityremains subjectto enforcementof all applicableregulations(includingcompliancewith Subpart F groundwatermonitoringFacilitiesthat are not in compliancewith RCRArequirements).regulationsare subjectto dingthose with temporaryorinformalexclusion)that had pending delistingpetitionson November8, 1985, were subjectto the Loss of InterimStatus(LOIS) provisionof the Hazardous and Solid Waste Amendments of 1984 (HSWA).Facilitiesthat failedto validlycertifycompliancewith SubpartsFand H and submit a Part B applicationfor an operatingpermiton orto cease operatingtheirbefore November 8, 1985 were requiredhazardouswaste land disposalunitsand submit a closureplan forthose unitsby November 23, 1985.Facilitieswith pending delistingpetitionsthat failedto retaininterimstatusand continuedtoto submit the requiredoperateafterNovember 8, 1985, and/or failedclosureplan are subjectto enforcementactionsunder Section3008 ofRCRA.1 Facilitieswhose only waste was subjectto a temporaryorinformalexclusionwere not requiredto meet Part 265 standardsduringthe effectivetime of the exclusion.However, all temporaryandinformalexclusionsthat had not previouslybeen acted on expiredbystatuteon 11/8/86(Section3001(f) (2) (8)).Facilitiesthat hadeithera temporaryor informalexclusionwere in one of fourcategorieson 11/8/86:(1) the finaldelistingwas grantedand thatwaste is no longer subjectto regulationunder RCRA; (2) the petitionwas denied when, afterrepeatedrequestsfrom the Agency, the facilityfailedto provideadditionalinformationfor the petition;thesefacilitieshad to be in compliancewith Part 265 regulationsimmediately;(3) the completedpetitionwas denied based on the meritsof the petition(i.e.,the waste was determinedto be hazardous);these facilitieshad six months from the date of publicationof thedenialin the FederalRegisterto come into compliancewith Part 265standards;or (4) the exclusionexpiredby statute;these facilitiespetitionsmoved back into the standarddelistingprocess and thefacilitieswere immediatelysubjectto all applicableRCRArequirements,RetypedFrom The Original
