§15-101Motor Vehicles and Traffic§15-104Part 1General Regulations§15-101.Definitions and Interpretation.1. Words and phrases, when used in this Part, shall have the meanings ascribedto them in the Vehicle Code of Pennsylvania, as now in force, or as hereafter amended,enacted, or reenacted, except where the context clearly indicates a different meaning.2. The term “legal holidays” as used in this Part shall mean and include: NewYear’s Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, andChristmas.3. In this Part, the singular shall include the plural, the plural shall include thesingular, and the masculine shall include the feminine and the neuter.(Ord. 456, 1/6/1975, §7-1001)§15-102.Manner of Adopting Permanent Traffic and Parking Regulations.All traffic and parking regulations of a permanent nature shall be enacted asordinances or as parts of ordinances or as amendments to ordinances of the Borough.(Ord. 456, 1/6/1975, §7-1002)§15-103.Temporary and Emergency Regulations.The Mayor, Borough Manager and Chief of Police shall have the following powersto regulate traffic and parking temporarily and in time of emergency: [Ord. 624]A. In the case of fire, flood, storm, or other emergency, to establish temporarytraffic and/or parking regulations.B. In the case of emergency or to facilitate public works, or in the conduct ofparades, processions or public events, to restrict or prohibit traffic and/or parkingin limited areas for periods of not more than 72 hours. Such temporary andemergency regulations shall be enforced by the Mayor and the Police Departmentin the same manner as permanent regulations. Any person who shall operate orpark a vehicle or tractor in violation of any such regulation, or who shall move,remove, destroy, injure, or deface any sign or marking erected, posted, or made togive notice of any such regulation, shall, upon conviction thereof, be liable to thepenalty set forth in the law or elsewhere in this Part for a violation of such nature,and, in case of a violation for which no specific penalty is set forth in the law orelsewhere in this Part, to a fine of not more than 10 and costs of prosecution, andin the event of a subsequent conviction thereof for every such violation thatconstitutes the same offense, be sentenced to pay a fine of not more than 10 andcost of prosecution and to imprisonment for not more than 5 days.(Ord. 456, 1/6/1975, §7-1003; as amended by Ord. 624, 1/19/2010)§15-104.Experimental Regulations.The Borough Council may, from time to time, designate places upon and along thehighways in the Borough where, for a period of not more than 90 days, specific traffic15-5HomeBackNext

§15-104Borough of Mount Pleasant§15-105and/or parking regulations, prohibitions, and restrictions shall be in force and effect,and shall designate such locations by proper signs and markings. Such regulations,prohibitions, and restrictions shall be effective just as if they had been specified by thisPart. No person shall operate or park a vehicle or tractor in violation of any suchregulation, prohibition, or restriction, and no person shall move, remove, destroy, ordeface any sign or marking erected, posted, or made by authority of this Section. Anyperson who shall violate any provision of this Section shall, upon conviction thereof, beliable to the penalty set forth in the law or elsewhere in this Chapter, to a fine of notmore than 5 days. §15-201Motor Vehicles and Traffic§15-204Part 2Traffic Regulations§15-201.Motor Vehicles Not to Be Driven on Sidewalks.No person shall operate a motor vehicle or tractor upon any sidewalk in theBorough; nor shall any person operate a motor vehicle upon or across any sidewalkexcept in order to gain access to or egress from a driveway or alley at such locationswhere the curb, if such sidewalk is curbed, shall have been properly cur down for thepurpose. Any person who shall violate any provision of this Section shall, uponconviction thereof, be sentenced to pay a fine of not more than 100 and costs ofprosecution, and in the event of a subsequent conviction thereof for every such violationthat constitutes the same offense, be sentenced to pay a fine of not more than 100 andcost of prosecution and to imprisonment for not more than 10 days.(Ord. 456, 1/6/1975, §7-2001; as amended by Ord. 624, 1/19/2010)§15-202.Speed Limits Established.1. No person shall operate any motor vehicle or tractor upon any of the streetsand highways of the Borough at a greater speed than is reasonable and proper havingregard to the width, traffic, and use thereof, or so as to endanger the property or life orlimb of any person.2. The speed limits for the streets, or portions of streets within the Borough arehereby established for those streets, or portions of streets listed in Appendix 15-IA,hereby incorporated herein.3. Any person who shall operate a vehicle or tractor at a speed in excess of thatestablished therefor, upon any highway or portion thereof specified in this Section, uponconviction thereof, shall be sentenced to pay a fine of 35 and costs. Any personexceeding the maximum speed limit by more than 5 miles per hour shall pay anadditional fine of 2 per mile for each mile in excess of 5 miles per hour over themaximum speed limit. Official traffic control signals shall be erected (or if heretofore erected arehereby ratified) at the intersections listed in Appendix 15-IB hereby incorporatedherein. Traffic at such designated intersections shall be directed by such signals.2. Any driver of a vehicle who disobeys the directions of any traffic signal, uponconviction, shall be sentenced to pay a fine of 25 and costs. Any person who shall operate a motor vehicle or tractor upon any highway orportion thereof hereby established as a one-way highway other than in the directionhereby established for traffic thereon shall, upon conviction thereof, be sentenced to paya fine of not more than 25 and costs of prosecution, and in the event of a subsequentconviction thereof for every such violation that constitutes the same offense besentenced to pay a fine of not more than 25 and cost of prosecution and to imprisonment for not more than 10 days. No operator of any motor vehicle shall make a u-turn upon any of the streetsof the Borough.2. Any person who shall violate any provision of this Section shall, uponconviction thereof, be sentenced to pay a fine of not more than 25 and costs ofprosecution, and in the event of a subsequent conviction thereof for every such violationthat constitutes the same offense, be sentenced to pay a fine of not more than 25 andcost of prosecution and to imprisonment for not more than 5 days. It shall be unlawful for the operator of any vehicle or tractor, traveling uponthe first-named highway at any of the intersections specified in Appendix 15-ID, herebyincorporated herein, in the direction or directions therein indicated in each case, tomake a left turn and/or a right turn at the said intersection, as therein indicated.2. Any person who shall violate any provision of this Section shall, uponconviction thereof, be sentenced to pay a fine of not more than 25 and costs ofprosecution, and in the event of a subsequent conviction thereof for every such violationthat constitutes the same offense, be sentenced to pay a fine of not more than 25 andcost of prosecution and to imprisonment for not more than 5 days. The intersections specified in Appendix 15-IE, hereby incorporated herein, areestablished as stop intersections, and official stop signs shall be erected (or are herebyconfirmed if heretofore erected) in such a position as to face traffic approaching thesecond-named street upon the first-named street, in the direction or directions thereinindicated. All vehicles and tractors approaching any such intersection upon the firstnamed street in the direction or directions therein indicated in each case, shall come toa full stop, within a reasonable distance, before entering any such intersection.2. Any operator of a vehicle or tractor who shall fail to come to a full stop, withina reasonable distance, before entering any stop intersection, as herein above required,upon conviction thereof, shall be sentenced to pay a fine of 25 and costs. §15-208§15-208.Motor Vehicles and Traffic§15-210Yield-Right-of-Way Intersections Established.1. The intersections specified in Appendix 15-IF, hereby incorporated herein, areestablished as yield-right-of-way intersections and official yield signs shall be erected(or are hereby ratified if heretofore erected) in such a position as to face trafficapproaching the second-named street from the first-named street, in the direction ordirections therein indicated. All vehicles and tractors approaching any such intersectionupon the first-named street, in the direction or directions therein indicated, shall yieldthe right-of-way to any vehicle in the intersection or approaching on the second-namedstreet so closely as to constitute an immediate hazard during the time that the operatorof such vehicle or tractor is moving across or within such intersection.2. Any operator of a vehicle or tractor who shall fail to yield the right-of-way, asherein above required, shall, upon conviction thereof, be sentenced to pay a fine of 25and costs of prosecution, and in the event of a subsequent conviction thereof for everysuch violation that constitutes the same offense, be sentenced to pay a fine of not morethan 25 and cost of prosecution and to imprisonment for not more than 3 days. [Ord.624](Ord. 456, 1/6/1975, §7-2008; as amended by Ord. 624, 1/19/2010)§15-209.Vehicle Weight Limits Established.It shall be unlawful for any person to operate on any street of the Borough anymotor vehicle, or other vehicle, tractor, trailer, or tractor-trailer combination, havingan aggregate or gross weight equal to or greater than the weight specified for suchvehicle in Appendix 15-IG, hereby incorporated herein, on the streets and/or highwaysor portions of streets and highways respectively described therein.(Ord. 456, 1/6/1975, §7-2009; as amended by Ord. 624, 1/19/2010)§15-210.Play Highways Authorized.1. The Mayor is hereby authorized to designate as play highways, whenever heshall deem such action advisable, and for whatever period of time directed by him, anyportion of any highway in the Borough, whereon sledding and coasting shall bepermitted. Such highway shall be set apart for the purpose under the direction of theMayor.2. No person shall operate any motor vehicle or tractor upon any play highwayat any time when such highway shall be so designated, except in case of emergency,,with special permission of the Mayor or of the police officer in charge, who shall firstclear such play highway for the purpose for which it was set aside. §15-301Motor Vehicles and Traffic§15-306Part 3Parking Regulations§15-301.Parking Without Lights Authorized.The boundary limits of the Borough are hereby established as a zone in whichmotor vehicles may remain standing without lights, and all highways within suchboundary limits are hereby designated as highways where motor vehicles may remainstanding without lights.(Ord. 456, 1/6/1975, §7-3001)§15-302.Vehicles to Be Parked Within Marked Spaces.Wherever a space shall be marked off on any highway for the parking of anindividual vehicle, every vehicle there parked shall be parked within the lines boundingsuch space.(Ord. 456, 1/6/1975, §7-3002)§15-303.Parking Prohibited at All Times.It shall be unlawful for the owner or operator of any motor vehicle or other vehicleto park such vehicle in any of the places on the streets and alleys of the Boroughspecifically designated in Appendix 15-IIA hereby incorporated.(Ord. 456, 1/6/1975, §7-3003)§15-304.Parking Prohibited Certain Days and Hours.It shall be unlawful for the owner or operator of any motor vehicle or other vehicleto park such vehicle in any of the places on the days and between the hours indicatedand specified in Appendix 15-IIB hereby incorporated herein.(Ord. 456, 1/6/1975, §7-3004)§15-305.Parking Time Limited Certain Days and Hours.It shall be unlawful for the owner or operator of any motor vehicle or other vehicleto park such vehicle or other vehicle to park such vehicle or allow the same to remainparked in any of the places on the streets and alleys of the Borough at any time on thedays and between the hours indicated and specified in Appendix 15-IIC herebyincorporated herein.(Ord. 456, 1/6/1975, §7-3005)§15-306.Special Purpose Parking Zones.It shall be unlawful for the owner or operator of any motor vehicle or other vehicleto park such vehicle or allow the same to remain parked in any locations on the streetsand alleys of the Borough established and designated as special purpose parking zonesindicated and specified in Appendix 15-IID hereby incorporated herein.(Ord. 456, 1/6/1975, §7-3006)15-11HomeBackNext

§15-307Borough of Mount Pleasant§15-307.§15-308Violations and Penalties.Any person who shall violate any provision of this Part shall, upon convictionthereof, be sentenced to pay a fine of not less than 10 nor more than 50 and costs ofprosecution, and in the event of a subsequent conviction thereof, for every such violationthat constitutes the same offense, be sentenced to pay a fine of not less than 10 normore than 50 and costs of prosecution and to imprisonment for not more than 5 days.It shall be the duty of the peace officers of the Borough to report to the Mayor allviolations of any provisions of this Part, indicating, in each case, the Section thereofviolated, the license number of the vehicle involved in such violation, the location wheresuch violation took place, the time of such violation and any other facts that might benecessary in order to secure a clear understanding of the circumstances attending suchviolation. The peace officer making such report shall also attach to every such vehiclea notice that such vehicle was parked in violation of this Part, which notice shallcontain instructions to the owner or operator of such vehicle that if he shall report tothe office of the Chief of Police and pay, for the use of the Borough, the sum of 5 within48 hours after the time of such notice, or if he shall place such sum of 5 enclosedwithin the envelope provided in any of the special parking fine boxes installed atvarious locations within the Borough within such time limit, the same shall save suchviolator from prosecution and from payment of the fine and costs herein aboveprescribed.(Ord. 456, 1/6/1975, §7-3007; as amended by Ord. 624, 1/19/2010)§15-308.Mechanical Padlocking Device.1. This Section is enacted as an enforcement procedure for protection of the publicpeace, safety, and welfare, and the safeguarding of property, and shall be usedgenerally for the prevention and removal of traffic hazards, prevention, and abatementof public nuisances arising from traffic law violations and for the protection of thepublic rights in the use of Borough streets and thoroughfares.2.Definitions.A. For the purpose of this Section, all automobiles, trucks, truck-tractors,trailers, and other vehicles of any kind shall hereafter be referred to as “vehicles.”B. For the purpose of this Section “boot” means a device consisting of metalclamps or jaws and a padlocking device which, when attached to the wheel of amotor vehicle, prevents the vehicle from being driven.3. Any vehicle found on any public street, public parking lots of the Borough ofMount Pleasant having charged against the owner or owners thereof five or moreunpaid summonses or other process for motor vehicle traffic or parking violations issuedwithin a 2-year period, charging that such vehicle was parked, stopped, or standing inviolation of any law or ordinance of the Borough of Mount Pleasant, shall be deemed apublic nuisance and the Department of Police and any other agent of the Boroughassigned to traffic duty are hereby authorized to:A. Remove, or cause to be removed, such vehicle at the expense of the owneror owners of such vehicle or at the expense of the habitual violator.B. Immobilize for up to 168 hours by means of applying a boot and then toremove such vehicle or cause to be removed at the sole cost and expense of thehabitual violator. §15-308Motor Vehicles and Traffic§15-308this subsection, a notice shall be placed on such vehicle, in a conspicuous manner,sufficient to warn any individual that such vehicle has been immobilized and thatany attempt to move such vehicle may result in damage thereto.4. The registered owner or owners of a vehicle having against it five or moreoutstanding summonses shall be presumed to the owner or owners at the time thesummonses were in fact issued and shall be severally responsible for the offenses andthe impoundment or immobilization except where the use of the vehicle was securedby the operator without the owner or owners consent.5. Vehicles immobilized or impounded pursuant to this Section shall be releasedto their lawful owner or owners entitled to possession upon a showing of adequateevidence of a right to its possession and upon paying all accrued fines and costs for eachoutstanding unpaid summons or depositing of the collateral required for his appearancein the magisterial district judge’s County to answer to each violation for which there isan outstanding or otherwise unsettled traffic violation notice or warrant and, inaddition there to, the charges for immobilizing, towing, and storage. [Ord. 624]6.Duties of the Chief of Police.A. The Chief of Police is hereby authorized to impose and collect a charge of 50 to cover the costs of immobilization of vehicles. A notice of this charge shall begiven on the warning notice placed on each immobilized vehicle as provided in thissubsection of this Part.B. The Chief of Police is hereby authorized to impose and collect charges fortowing and storing impounded vehicles as set forth in subsection .4 of this Section.7.Charges Paid under Protest.A. Payment of immobilization, towing, and storage charges unless madeunder protest shall be final and conclusive, and shall constitute a waiver of anyright to recover the money so paid.B. If the immobilization, towing, and impounding charges are paid underprotest, the offender shall be entitled to a hearing before a magisterial districtjudge having jurisdiction. The defendant shall be proceeded against and receivesuch notice as is provided by the Commonwealth Vehicle Code, 75 Pa.C.S.A. §101et seq., in other cases of summary offenses, and shall have the same rights of appealand waiver of hearing. If the magisterial district judge acquits the defendant, theBorough shall within 14 days refund to the defendant the amount of immobilization, towing, and storage charges paid by him or in his behalf. §15-401Motor Vehicles and Traffic§15-405Part 4On-Street Metered Parking§15-401.Parking Meter Zones Established.Parking meter zones are hereby established upon and along certain streets of theBorough as indicated and described in Appendix 15-IIIA hereby incorporated herein,except for such spaces within such parking meter zones where parking is now or shallhereafter be prohibited.(Ord. 456, 1/6/1975, §7-4001)§15-402.Hours.Parking Time Limit in Parking Meter Zones; Certain Days andIt shall be unlawful for any owner or operator of any motor vehicle or other vehicleto park such vehicle between the hours on any day, except Sundays and legal holidays,for more than the time specified for any of the streets or portions of streets listed anddescribed in Appendix 15-IIIA hereby incorporated herein.(Ord. 456, 1/6/1975, §7-4002)§15-403.Placement and Characteristics of Parking Meters.Parking meters installed in the parking meter zones established as provided in §15401 of this Part shall be placed upon the sidewalk and immediately adjacent to theindividual parking spaces hereinafter described. Each parking meter shall be placed orset in such manner as to show that the parking space adjacent to such meter is or is notlegally occupied. Each parking meter installed shall indicate by a proper legend thelegal parking time established by the Borough and, when occupied shall indicate on andby its dial and pointer the duration of the period of legal parking and, on the expirationof such period, shall indicate illegal of overparking.(Ord. 456, 1/6/1975, §7-4003)§15-404.Parked Vehicles to Be Wholly Within Marked Spaces.Lines and/or markings shall be painted or placed upon the curb, sidewalk, and/orhighway adjacent to each parking meter for the purpose of designating the parkingspace for which such meter is to be used.
